Q: How long will it take to get investors some of their money back?
A: Unfortunately, several months. Mr. Reynolds is asserting his Fifth Amendment right against self-incrimination, refusing to be interviewed by the Receiver. The person who is in the best position to answer questions about Success Trust, therefore, has chosen not to do so. The Receiver must, therefore, get those answers from other witnesses and from examination of the documents retrieved. So far, we have retrieved a stack of documents more than five stories high. We are working through those documents methodically, but as quickly as possible, to draw from them the information we need to prepare the accounting ordered by the Court, and to propose a plan of distribution.
Q: What experience does the Receiver have in cases like this?
A: The Receiver was an Enforcement Branch Chief at the SEC. During his time there he investigated several Ponzi scheme cases and at least one Prime Bank scam. He has spent the ten years since returning to private practice representing the interests of defrauded investors.
Q: How does a Receiver help us when he is getting paid out of the frozen assets?
A: Whatever the investors were led to believe, to date the Receiver has found no profit-generating business in Success Trust, only a pattern of collecting money from investors and spending a great deal of it on Mr. Reynolds's personal expenses. If the SEC had not stepped in, all of the investor funds would likely be gone by now. The trading programs described in the Success Trust marketing documents simply do not exist.
Without a Receiver, there would be no way to determine who is entitled to return of some of their "investment." Without a Receiver, there would be no one authorized to search out other assets that might be brought into the Receivership Estate for eventual distribution to defrauded investors. Without the SEC's quick work, there would likely be no money left at all.
Please rest assured that the Receiver is highly motivated to achieve the best possible result for defrauded investors. Although his assignments are time-consuming, he is doing no unnecessary work and is closely monitoring the time spent by the professionals he has hired to help him with this case to ensure that every minute spent on the case is absolutely necessary.
Q: What has happened to the personal information I sent to Success Trust?
A: The Receiver has custody of those documents. Most of those packets contain copies of driver's licenses and social security cards, everything an identity thief would need. The Receiver is organizing those documents and will keep them safe. At the conclusion of the case, the Receiver will dispose of them in a way designed to ensure that they do not fall into the hands of anyone else.
